I am expecting to see a similar if not greater number of bills introduced in areas normally monitored by TFA this year particularly if Speaker Naifeh era is over. I strongly encourage - and would encourage you to call your legislators to encourage - that an ad hoc commission be established of legislators and a few non-legislative experts (not just district attorneys and law enforcement but real experts on 2nd Amendment issues) to review and make recommendations on appropriate legislation. If this is not done, Tennessee is at serious risk that the problems we have seen during the last 2 years with poorly drafted and/or understood 2nd Amendment legislation will materially increase.

Here is what has been filed already. Out of this meager number, we already see a pattern of individual legislators writing bills without consulting necessarily with experts in the areas and duplicate legislation is already surfacing.

HB 0004*
(Full Text) Exemption for certain handgun carry permit requirements. Clarifies that a person who is exempt from classroom and firing range training requirement by reason of prior military experience is also exempt from payment of $115 application and processing fee. (H: Bass)
House Co-Sponsor: Turner M.

TFA Opposes this legislation. TFA pushes for general legislation that would reduce the costs of the permit for all Tennesseans. Legislation which reduces the fee for only segments of the population make it less likely to obtain fee reductions for other segments because the State still has to process the applications for other proposed exempt classes and the costs of doing that work makes fee reductions on fee paying civilians less likely.

(Full Text) Crime-Free School Zone Act. Enacts the "Crime-Free School Zone Act." Enhances penalties and fines for violent and certain other crimes committed within 1000 feet of any school, public or private, child care agency, public library, recreation center or park. (H: Hardaway)

TFA opposes this poorly drafted legislation.


HB 0045*
(Full Text) Handgun carrying permit. Clarifies that no applicant for a handgun carry permit that is participating in a handgun safety course is required to furnish any information concerning the handgun the applicant owns, possesses, or uses during the safety course. (H: Hill)
House Status: Introduced 1/13/2009

TFA will support some form of legislation on this topic. TFA strongly encourages House and Senate leadership to establish a commission to review all firearms related legislation.

(Full Text) Handgun information privacy. Prohibits department of safety or any department approved handgun safety course employee from requiring applicant for handgun carry permit to furnish any identifying information concerning any handgun the applicant owns or possesses. (H: Evans)

(Full Text) Constitional amendment - right to hunt and fish. Adds provisions to the state constitution to establish the right to hunt, fish, and harvest game subject to reasonable rules and regulations. Establishes standard for reviewing such rules and regulations. (S: Norris)

(Full Text) Child safety in operation of off-highway motor vehicles. Establishes an offense for any parent or legal guardian of a person under 18 years of age to permit that person to operate or be a passenger on an off-highway motor vehicle without an appropriate helmet. (H: Hardaway)
